  • Time spent in courses (required for CE compliance)
  • Certificates earned and CE hours accumulated

When you access our platform, we automatically collect:

2. How We Use Your Information

We use the information we collect to:

3. FERPA and Educational Records

While Pathways is not a degree-granting institution subject to FERPA in the traditional sense, we apply FERPA-aligned principles to the protection of your educational records. Your course completion records, assessment scores, and CE transcripts are treated as confidential and will not be disclosed to third parties without your explicit written consent, except as required by law.

4. Data Sharing and Disclosure

We do not sell, trade, or rent your personal information to third parties. We may share your information only in the following circumstances:

  • With your consent: When you authorize us to share your CE records with a state board, employer, or certification body
  • Service providers: With trusted third-party vendors who assist in operating our platform (payment processing, email delivery, hosting), bound by confidentiality agreements
  • Employer accounts: If your employer has a facility account and has enrolled you in courses, your course progress and completion data may be visible to designated administrators at your organisation
  • Legal requirements: When required by law, subpoena, or governmental regulation
  • NAADAC/Board audits: If required during a provider audit by NAADAC or a state certification board, we may be required to produce records of course completions; we will notify affected learners when possible

5. Cookies and Tracking

We use essential cookies to maintain your session and track course progress. We may also use analytics cookies to understand how our platform is used. You can control cookie preferences through your browser settings. Disabling essential cookies may prevent the platform from functioning correctly, particularly the timed tracking features required for CE compliance.

6. Data Retention

We retain your educational records (course completions, certificates, CE hours) for a minimum of seven (7) years from the date of course completion, as required by NAADAC provider standards and most state board regulations. Account information is retained for as long as your account is active. You may request deletion of your account, but we are required to maintain CE completion records for the regulatory retention period.

7. Data Security

We implement industry-standard security measures to protect your personal information, including encryption of data in transit (TLS/SSL) and at rest, secure password hashing, regular security assessments, and restricted access controls. However, no method of electronic transmission or storage is 100% secure.

8. Your Rights

You have the right to:

  • Access your personal information and educational records
  • Request correction of inaccurate information
  • Request a copy of your CE transcript
  • Opt out of marketing communications
  • Request deletion of your account (subject to regulatory retention requirements)

9. Children's Privacy

Our platform is designed for adult professionals and is not intended for individuals under 18 years of age. We do not knowingly collect personal information from children.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the updated policy on our platform and, where appropriate, by email. Your continued use of the platform after such changes constitutes acceptance of the updated policy.
