Terms of Service

These Terms of Service (“Terms”) govern your use of the Pathways Behavioral Health Education online continuing education platform (“Platform”), operated by Stone Orca LLC. By accessing or using the Platform, you agree to be bound by these Terms.

1. Account Terms

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate, current, and complete information during registration, including your legal name and professional credentials.
• Your account is personal and non-transferable. You may not share your account or allow others to access courses under your account.
• You are responsible for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

2. Course Enrollment and Access

• Individual purchases: When you purchase an individual course, you receive lifetime access to that course content and may retake the course and assessment as needed.
• Subscription access: Annual Unlimited subscriptions provide access to all courses during the active subscription period. If your subscription expires, you retain access to any certificates earned but lose access to course content.
• Facility accounts: Facility/group accounts are governed by separate agreements. Access is limited to designated staff members of the enrolling organisation.

3. Continuing Education Credits

• CE hours are awarded upon successful completion of all course requirements, including minimum time-in-course requirements and passing the post-test assessment with a score of 75% or higher.
• Pathways is an approved education provider through NAADAC (Provider #12345). Our courses may also be accepted by IC&RC, FCB, TCBAP, and other state certification boards as indicated on each course page.
• It is your responsibility to verify that a course meets the specific CE requirements of your state board or certification body before enrolling.
• Pathways does not guarantee that any particular state board will accept our CE hours. Board acceptance policies may change.

4. Certificates

• Certificates of completion are generated automatically upon successful completion of course requirements.
• Certificates contain your name, credentials, course title, CE hours, completion date, and our NAADAC provider number.
• You are responsible for submitting certificates to your state board or certification body as required for your renewal.
• We maintain records of your course completions for a minimum of seven (7) years and can re-issue certificates upon request.
• Any attempt to falsify or alter a certificate is strictly prohibited and may result in account termination and notification to relevant certification bodies.

5. Payment Terms

• All prices are listed in US dollars.
• Payment is required at the time of purchase for individual courses.
• Subscription fees are billed annually on the anniversary of your subscription start date.
• We accept major credit cards and other payment methods as displayed at checkout.
• All payments are processed securely through our third-party payment processor.

6. Refund Policy

• Individual courses: We offer a full refund within 30 days of purchase if you have not completed more than 25% of the course content. Once you have completed the post-test or received a certificate, no refund is available.
• Subscriptions: We offer a full refund within 30 days of initial purchase or renewal. After 30 days, the subscription is non-refundable for the current billing period.
• Facility accounts: Refund terms are governed by your facility agreement.

7. Minimum Time Requirements

Many state boards require documentation that learners spent a minimum amount of time reviewing course material. Our platform tracks time-in-course and enforces minimum time requirements for each module. You may not attempt to circumvent these tracking mechanisms. Any attempt to manipulate time tracking may result in invalidation of your CE credit and account termination.

8. Assessment Integrity

• Post-test assessments must be completed individually without assistance from others.
• You may not copy, distribute, or share assessment questions or answers.
• If you do not pass the post-test (75% threshold), you may retake it. There is no limit on retake attempts.
• We reserve the right to invalidate assessment results if we have reason to believe academic integrity was compromised.

9. Intellectual Property

• All course content, including text, videos, images, assessments, and supplementary materials, is owned by Pathways Behavioral Health Education or our content creators and is protected by copyright.
• You are granted a limited, non-exclusive, non-transferable license to access course content for your personal professional development.
• You may not copy, reproduce, distribute, publicly display, or create derivative works from our course content without prior written permission.
• You may not record, screenshot, or otherwise capture video content from our courses.

10. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Share your account or course access with others
• Attempt to circumvent time tracking or assessment security measures
• Submit false or misleading information about your identity or credentials
• Interfere with the Platform's operation or security
• Use automated tools to access the Platform

11. Limitation of Liability

To the maximum extent permitted by law, Pathways Behavioral Health Education and Stone Orca LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of professional licensure, arising out of or related to your use of the Platform. Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Platform and all course content are provided “as is” and “as available.” While we strive to provide accurate, current, and clinically sound educational content, we make no warranties regarding the completeness, reliability, or accuracy of course material. Course content is for educational purposes only and should not be used as a substitute for clinical supervision, legal advice, or professional consultation.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
